Trends in Biometrics Legislation, Regulation and Litigation
The biometric privacy legal landscape is fast evolving. Private litigation is raging under the Illinois Biometric Information Privacy Act, with more than 1,500 related cases filed to date. The Federal Trade Commission and state regulators are increasingly overseeing uses of biometric data, along with new and pending laws governing biometrics. We’ll discuss trends and theories from the plaintiffs’ bar, describe regulators’ areas of focus and highlight key new legislation. We’ll also discuss practical strategies companies can use to reduce litigation and regulatory exposure associated with their use of biometric data. Cooley lawyers Bethany Lobo, Liza Cotter and Andrea Batalla Eguidazu will lead this presentation.

Bethany is an experienced litigator who handles cases from pleading stage to appeal for companies facing high-value business model challenges. Bethany is a partner in Cooley’s cyber/data/privacy practice group, which has been recognized repeatedly by Law360 as Privacy Practice of the Year.

Liza focuses her practice on privacy, data protection and cybersecurity, advising clients across multiple industries on national and international regulatory compliance, data protection best practices, use of artificial intelligence and machine learning, and identifying, responding to, and remediating data breaches and other security incidents. She also has extensive experience negotiating technology transactions and conducting privacy and data security diligence in corporate transactions.
